TERMS AND CONDITIONS OF USE OF THE AB E-SHOP

GENERAL

AB's E-shop is the official e-shop for the sale of products through the internet which was created by the public limited company registered as “ALFA – BETA VASSILOPOULOS SA”, with GCR number 000267201000 and TIN 094025817, seated in Gerakas, Attica, Greece (81 Spaton Ave.) and legally represented (hereinafter "AB"). 
The operation of the e-shop is governed by the special terms herein, as well as the general terms of use of www.ab.gr, and where contradictory the special terms supersede the general terms.
Users are requested to carefully read and comply with the e-shop's terms of use. AB assumes that before visiting the e-shop, users have been informed of these terms, as in effect from time to time, and have accepted them unreservedly. The use of the e-shop implies unreserved acceptance of the terms; users who do not agree in whole or in part with these terms should not use the e-shop. In any event, the terms must be accepted before completing an order; otherwise, the order cannot be delivered.

 

USE OF THE e-SHOP

The e-shop may be used by individuals capable for legal transactions who are over 18 years of age. Each user shall be presumed to meet the above criteria, as shall those persons mandated by the user to receive an order. AB bears no responsibility as it cannot carry out any verification of the data.
In order to use the e-shop, a personal web account must first be created based on the terms and conditions contained in the terms and conditions of www.ab.gr. Please note that even those without a personal account are welcome to browse the e-shop; however, once they begin to select items to create an order, they will be asked to create a personal account.
As users commence to use the e-shop, they will be asked to provide the postal code (PC) of the area where the order is to be delivered in order to verify that the specific address is served by an AB store. In the event the area is not served, users will be informed automatically by the system before an order is created. Stores and service areas are established by AB at its absolute discretion and it is therefore possible that a particular area may not be served by an AB store. In any event, before an order is completed, users must enter an address where products are to be delivered. Each user is solely responsible for the information provided, which must be true and accurate. If AB ascertains that incorrect information has been submitted, it is entitled to cancel the specific user's registration.

Every visitor of the online store can use the online store and create an order even without creating an account. In the case that someone decides to use the services as a "guest" without creating an account, these terms and special terms apply which are listed below in the "Guest Check Out" section.

 

PRODUCTS / PRICES

AB is bound as to the quality, thoroughness and validity of information provided, both as regards the identity of the e-shop and the products provided through it. Specifically, as the seller of the specific products, AB retains all legal rights and obligations; nevertheless, responsibility to the final consumers for faulty products and/or information related to goods and written on their packaging is also borne by the producer/supplier of these products. As regards the extent of its own responsibility, AB faithfully complies with specifications for proper storage, cooling and transport to the final recipient.
AB endeavours to provide a wide range of products for consumers through its e-shop that is comparable to the variety available at each of its stores. Nevertheless, it is possible that users may not find certain products or a particular category of products, and this is due either to the company's business policy or to the configuration of the e-shop. Product availability may vary depending on your postcode and the service / execution point of your online order.
Products are presented to consumers through photographs, on which users can zoom in to learn more and to obtain information about the product; these are those required to be printed on the packaging based on legislation in force from time to time. It is clarified that images are updated at regular intervals; however, information showing the date of manufacture/packaging, expiration or information showing various measurement /cost values or changing indications are those applicable at the time the image was taken and may have changed. AB guarantees that the products delivered to consumers will have the normal shelf life, based on laws in force, normal practices and business ethics. 
AB guarantees that the products provided through the e-shop are safe and suitable for consumption, and that all health and safety regulations have been observed at all stages within AB's remit (production, storage, transport, etc.). 
AB has received comparable guarantees from its suppliers, who are ultimately liable to the final consumer.
Prices indicated on the e-shop site are the same as those for products distributed through AB's network of stores. Any difference in prices that may occur during different visits to the e-shop reflects AB's pricing policy, which aims at maintaining AB's competitiveness. Prices indicated are final and include applicable VAT, but not delivery costs (if applicable). Prices are listed according to the applicable market regulations. It is possible, however, that the same product may be priced differently within the same day based on the company's business policy. Goods which are available for sale at favourable prices from the stores may not be priced the same when purchased through the e-shop and vice versa. Cash refunds for goods purchased as part of a special offer, promotional programme or action or during sales periods will be made on the basis of the price of the special offer, promotion or discount. All special offers are effective for a specified period of time on the condition that the product on offer is available and provided there is adequate stock. Charges will be based on the applicable prices posted on the e-shop at the date and time the order was placed, even if fluctuations have occurred, as these are the prices that have been notified to the customer at the time the order was placed, which the customer has accepted by submitting the order. The same applies for fresh products. Due to their nature and to ensure freshness and quality, fresh products, such as, but not limited to, meat/poultry/fish/fruits/cheeses, will be weighed on the order execution date, but will be charged by unit price at the time of the order, as mentioned above. It is expressly stated that a different unit price and final selling price may be indicated on products, as, according to AB's commercial policy, the product prices may have changed from the date on which the order was placed to the date of its execution; the price charged however shall always be that applicable at the time of the order as mentioned above. In no case does any different price indication on the product signify a different product price and a different charge price. In case of product replacement, due to shortage, and after the customer's consent, the product included in the order will receive the price that the product has on the day of execution of the order and not that of submission. For this purpose, it is clarified that in case an item has already been included in the order and the same item is added in place of another at the time of execution of the order, the second item will take the price of the item at the time of execution of the order and the receipt will both values ​​are included, that of the time of submission of the order and that of the time of its execution.
 
PRODUCT DELIVERIES

Products are delivered by AB either at the address stated, or at the store chosen by the user.  The delivery of the products is free if the final estimated value of the order is €45 or more. For orders whose value varies from the minimum cost of this, i.e. €25, up to €44.99, the shipping cost is set at €2 and is included in the estimated value of the order. For specific delivery timeslots, the minimum order cost is €60 and there is no delivery cost.
For the delivery of orders, AB uses paper and biodegradable bags, as, in the context of its corporate social responsibility, it is abolishing plastic bags to help towards a cleaner environment. 
The order packaging cost depends on the order value. The minimum packaging cost is set at the token amount of 0.35€, calculated taking into account the average number of items in the minimum permissible order value; the maximum amount is 2.31€, depending on order value. 
The order value does not include savings from €6 AB Plus discount vouchers.
If the final value of the order changes due to product shortages or replacements, the order packaging cost remains the same, as the calculation is made by the system when the order is placed and cannot be modified.

ORDERING PROCESS

Users select the products they want from among the products available through AB's e-shop. The selection of products is always up to each user. The dispatch of any acknowledgement of entry of an order by AB does not constitute acceptance of the order, which in any case depends on availability and stock.
The estimated total value of an order appears upon selection of products, and depends on the desired quantity and the total number of products selected.
The minimum estimated total value of all selected products must be at least €25 for an order to be accepted and filled. For specific delivery timeslots, the minimum order cost is €60. The above minimum estimated total values ​​(€25.00 or €65.00 depending on the case) are formed after deducting any discounts by redeeming points from the online account, offers in the context of promotions (promo codes) as well as any other discount from gift cards / vouchers, etc. When selecting products, there is no minimum size for a product, either in weight or in quantity or in value; it is possible, however, that AB may establish a maximum volume per item for certain product categories, which will be made known to users through the e-shop. It is also possible that products sold in unpackaged form may be offered either by unit or by specific quantity, according to normal practices. In such cases, users will be informed through the e-shop and may elect to purchase either a unit or a specific quantity or multiples thereof. All restrictions established by AB must be observed for an order to be accepted.
Given that some products are offered on the basis of weight and that the final weight may deviate from the quantity ordered by approximately 10%, users accept this deviation, as it is considered reasonable based on normal practices and past experience. Thus, the final charge for these products will be based on the final weight at the time the order is filed, according to the unit price at the time of the order.
In the event that some products ordered are not available on the day the e-shop order is filed, AB will inform the customer, who must then decide either to substitute these with other similar products, or to have the order only partially filled, or to cancel the order as outlined below. AB is not liable to customers for non-acceptance and non-execution of all or part of an order. In any event, users acknowledge and accept the execution of the order, as this is ultimately finalised based on availability.
Before the order is completed, the user selects the date and time of delivery based on options provided by the system. All information must be true, complete and accurate. AB is not liable for non-delivery of the order if a non-existent address has been provided or in the event that there is no building at the address provided, or if the individual listed as the order recipient does not exist at the specific address. 
Upon completion of the order, the total estimated amount, excluding any discounts as mentioned above, will be displayed. This amount is not final; the user is aware of this and accepts it as products with variable weight may be included and some products may not be available at the order execution time.
Once the order has been completed, users will receive a message at the e-mail address they have provided with the details of the order and the chosen payment method.
Upon receiving the order, users/customers must check that all ordered items are there, checking against the order as after any replacements, as mentioned above. If certain items included in the delivery were not ordered, customers must immediately inform the company and request the return of the specific items. AB will arrange to collect these items.

 

ORDER PAYMENTS
The ordered products may be paid for either at the time of receipt by cash or by using a credit or debit card or by online payment. 

i CASH ON DELIVERY:
Users are informed of the final amount they have to pay. In the event users question the amount, either in total or in part, they may withdraw and refuse to accept the order in full, or to refuse to accept certain products. In the latter case, the cost of products not accepted upon delivery will be subtracted from the total and a corresponding credit note will be issued. The customer shall pay the rest of the sum.
Users must inform AB whether they intend to pay for the order when it is delivered in cash or by credit/debit card. Please note that users are not required to provide credit card information when placing an order, as the card will be charged in real time at delivery, when the user accepts the order and its value, as finalised according to the above.
For online orders, €6 paper vouchers that the user has in his possession from the use of the loyalty card are not accepted. These vouchers can be used for purchases in physical stores. If the user has an account and has connected the AB PLUS card he will be able to receive the discount of the points he has collected from his purchases and use them only if he activates the "digital wallet". In this case the amount accumulated in the "digital wallet" is automatically deducted from the value of the transaction. The user, when completing the order, can declare any digital discount coupons/vouchers he has available and their value. The value of the digital discount coupons that may be accepted will be deducted both from the total estimated cost and from the final payment amount, in case there is a difference. It is clarified that a) in order for someone to be able to declare the digital discount vouchers in his possession, the total estimated cost of the order, after subtracting the digital discount vouchers, must be equal to or greater than the minimum order set, b) the user cannot declare digital discount coupons with a total value greater than the estimated value of his order or such a value that the final amount of the order to be formed below the minimum order set, c) each user accepts that in the event that the final payment amount is less than the value of the digital discount coupons that have been declared, then so many coupons will be deducted so that the final payment amount is at least equal to the minimum order set.

ii ONLINE PAYMENTS

If users choose to pay for an order via online payment, they must fill in their card details. The online card payment service is supported by ALPHA BANK.
AB has taken all necessary technical measures to safeguard transactions and in no case retains card details in any form. Nevertheless, users should ensure that the environment from which they make the transaction is safe and that there is no risk of data leakage. In no case shall AB bear responsibility in the event that the user’s network or computer falls prey to malicious actions that may lead to the interception of card data. In the context of an electronic transaction security mechanism to safeguard transactions, upon filling in their card details, users are led to a secure environment in which the data is encrypted before being sent, to render it unreadable by third parties. They will then be asked to add a code to be sent to them in a message (SMS) to the mobile phone stated. The code is valid for five (5) minutes.
In online payments, the estimated cost of the order plus 5% will initially be reserved to cover any differences that may arise from products with variable weight or product replacements. It is clarified that reserving an amount does not imply that your card is charged. In case of reserved amounts, Users will notice a difference in the accounting and available balances of their account, as this amount has been reserved but has not been charged or deducted from their account.
Users will be informed of the final amount they will have to pay via an email to the email address they have stated. In the event users question the amount, either in total or in part, they may withdraw and refuse to accept the order in full, or to refuse to accept certain products. After duly informing the user, AB will charge the final amount. The release order is sent immediately upon the debiting of the final amount to the card. AB bears no responsibility for the final release of the amount and its appearance in the account of each customer, as this depends on the current procedures of each issuing bank. 
If the initially reserved amount is not sufficient to cover the cost of the order, users are obliged, if they have not withdrawn or contested the charge, to pay the excess amount at the time of the order delivery either by cash payment or by using a credit or debit card.
In the event that the user wishes not to make an online payment, they should cancel their order and resubmit it. Orders cannot be modified; they will need to be cancelled and resubmitted.
In case of order cancellation, AB will proceed to release the amount within three (3) business days. The amount will be available in the user’s account depending on the terms of the card issuing bank.
If the user does not receive certain products either because they are not in fit condition in accordance with usual practice or because they are replacement products, a credit note will be issued; AB will then proceed to refund the amount via the card used to place the order, within three (3) business days. The time at which the amount is made available in the user’s account depends on the card issuing bank. It is explicitly clarified that under no circumstances can a cash refund be made when a credit note is issued.

Use of "digital wallet": Regardless of the payment method, those of the customers who have a AB PLUS loyalty card, have linked it to their account and created a digita wallet, in accordance with the conditions applicable to the loyalty card, can choose to redeem an amount from the digital wallet by following the relevant steps to complete the order. In the event that the entire order is returned, then only in this case, AB will refund the amount which was used by digital with a corresponding credit of the corresponding value of points on the loyalty card. In any other case, the terms of the loyalty program apply.

 

CHANGE / CANCELLATION OF ORDERS

Users may change or cancel orders made through the e-shop by following the instructions. It is clarified that any order modifications or cancellations can be made up to six (6) working hours before the selected delivery time (working hours are from 08.00am to 21.00am, except Saturday and Sunday). The user may request to change the delivery time of his order to another time within the delivery day by calling AB's open communication line at 18202. If he wants to change the delivery day, he will have to cancel the original order and submit a new one.
In any case, users can contact AB’s customer care at 18202 for information on the possibility of cancelling or modifying their order (charge based on the applicable price list of each telecommunications provider).

 

DELIVERY / RECEIPT OF PRODUCTS

Upon receiving the order, users/customers must check the order.
Even upon delivery of the order, users are entitled to withdraw and to refuse to accept the order and its cost.

 

PRODUCT RETURNS

Users may request the return of products either because they are not the ones ordered or because the ones added as substitutes do not meet customer requirements. It is imperative that the packaging of products to be returned is intact and complete.
Note that fresh products can only be returned on the same day of delivery.
To return products, users must contact the AB customer care at 18202 to provide the details of the order and request the return of specific products. AB is responsible for collecting products for return; products will be collected by AB representatives.

 

RETURN OF DEFECTIVE PRODUCTS / RED BAG PROCEDURE

In the event that a defect is detected in any one of the products, users/customers may call the AB customer care at 18202 to learn about the red bag procedure, which is the procedure AB has established to control defective products by specially assigned employees. AB will arrange to collect any defective items. In the event that defective items must be returned, users may request they be replaced or ask for a cash refund.

 

WITHDRAWAL

Users are entitled to withdraw from orders of products which are not intended for immediate home use and which have a specific shelf life. Users/consumers have the right to withdraw from orders of the following product categories: electrical appliances/clothing*/bedding and other articles not intended for current household consumption and not having a specific lifetime.
Withdrawal is effected by filling out the withdrawal form referred to in the terms below. The withdrawal can be sent either by filling in the contact form at https://ask.ab.gr/s/contactsupport?language=el or by post to “ALFA – BETA VASSILOPOULOS SA 81 SPATON AVE., 15344 GERAKAS, ATTICA" marked "ORDER WITHDRAWAL". Users may exercise their right to withdraw and return the product as soon as possible, but no later than fourteen (14) calendar days from receiving it. 
Our company undertakes to collect the product from the location indicated by users and to replace said product if users so desire, or to refund the value of the product at the time of purchase. 
In all events, any item to be returned must be in its original and complete packaging, with all accessories and additions which accompanied its sale, and must include the original purchase receipts and any other enclosed document or item (e.g. labels, stickers, warranty leaflets, instructions for use, gift certificates, etc.). If any item is not in its original form, AB may refuse the return or may issue a reduced refund.
* Items which for reasons of hygiene or safety are not returnable pursuant to normal practices and business ethics are an exception.

PERSONAL DATA

AB, as the controller, keeps on file and processes the personal data declared, which in no case include special categories of data as defined in the European General Data Protection Regulation 2016/679 ("GDPR") and the applicable national legislation. These data may be received by third-party cooperating companies that have undertaken the advertising or promotion of AB’s products and/or services. 
When recording and processing personal data, AB, its employees and its servants shall comply with the provisions of the General Data Protection Regulation (EU) 2016/679 ("GDPR"), the applicable Greek data protection legislation and the decisions of the Data Protection Authority. In any case, the processing takes place in accordance with the choices made by the customer.
AB and the agents thereof implement the appropriate technical, material and organisational security measures in order to protect personal data against accidental or unlawful destruction or accidental loss, alteration, unlawful disclosure or access (including remote access) and against all other forms of illegal processing (including unnecessary collection or further processing). Those measures ensure a level of security that is appropriate to the risk, taking into account the evolution of technology, implementation costs and the nature, scope, context and purposes of processing.
AB and its agents ensure the confidentiality of personal data and do not disclose personal data in any way to any third party without prior notification of the data subject, except as expressly provided for in applicable law, such as where personal data must be disclosed to a competent public authority to comply with a legal obligation. AB shall ensure that persons authorised to process personal data are bound by the same confidentiality obligations. Personal data are collected for specified purposes, and in particular for the execution and servicing of the transaction relationship and shall not be further processed, unless the data subject him/herself has stated otherwise It is clarified that further processing for scientific or statistical purposes is not considered incompatible. Personal data is kept for as long as the user’s account is active and has not been cancelled. In case of cancellation, the data may be retained if there is a legitimate interest of AB or it has a legal obligation to do so. In this case, the retention period may not exceed five (5) years. Any individual may request from AB access to and rectification or erasure of personal data or restriction of processing, or to exercise one of the data subject rights to object to processing, or to data portability. The request is submitted to AB's Open Line (charges apply based on the pricelist of the respective telecommunications provider). Your request will be processed within 30 days.
The collection and processing of the personal data of e-shop users is governed by AB’s Privacy Policy.

 

COLLECT

In the context of ensuring optimal customer service, ALFA – BETA VASSILOPOULOS has created the “AB Collect” service. Users of the service can place an order through the e-shop and choose to collect it themselves from their chosen AB store. 
Important Information
• You should select your chosen store according to the list of available stores.
• You should select the pick-up timeframe from the store of your choice.
• The minimum basket value, for creating a Collect order, is €15.
• You then need to create your order and choose how you wish to pay for it. It is clarified that the minimum order value limits should be respected as defined above. By using the Collect service, you can pay upon receipt by cash or card as well as by Online Payment. Charges are made on the basis of prices in effect and posted on the e-shop on the date and time the order was submitted. The same applies for fresh products. Due to their nature and to ensure freshness and quality, fresh products, such as, but not limited to, meat/poultry/fish/fruits/cheeses, will be weighed on the order execution date, but will be charged by unit price at the time of the order, as mentioned above. It is expressly stated that a different unit price and final selling price may be indicated on products, as, according to AB's commercial policy, the product prices may have changed from the date on which the order was placed to the date of its execution; the price charged however shall always be that applicable at the time of the order as mentioned above. In no case does any different price indication on the product signify a different product price and a different charge price
• During the timeframe you have selected for picking up your order, 15 minutes before arriving outside the store you should call the store phone number you have received in the confirmation email to arrange to receive the order and proceed to pay for it.
• Food and gift vouchers can be redeemed by the AB Collect store, provided that the selected order payment method is by cash or card upon receipt and that they are delivered to the store. 
• If you have selected an online payment and you have registered 6€ AB PLUS discount vouchers, the 6€ discount vouchers calculated at the finalisation of the payment amount should be delivered to the store. Otherwise (if not presented), the difference should be paid upon delivery by cash or card. Any other difference that may arise based on the final payment amount and the number of €6 discount vouchers registered as mentioned above, must also be paid by cash or card.
• In the event that a product is in shortage, it will either not be delivered or will be replaced by another of the same product category after consultation / communication.
• If you do not arrive on time to receive your order, this will await you up to the store’s closing time on that day; you will not be able to seek it thereafter
• All matters not specified herein are governed by the terms of the e-shop

• If you choose the collect service, the value of the order includes the cost of packaging as mentioned above and delivery costs are not included

 

GUEST CHECK OUT

AB enables those who do not have an account or do not want to create an account, to make their purchases through the eshop by choosing to create an order as a "guest" ("Guest Check Out").
Through this option, the user is not required to create an account. However, it is requested to fill in the basic contact information, i.e. name, delivery address, telephone and contact email.
The conditions mentioned above also apply in the case you choose to use the online store as a "guest", without creating an account, except for the cases that are specifically regulated in this article and prevail as more specific.
Specifically when the user submits his order as a guest:

•    it cannot be modified,
•    he can request the cancellation of the order only through AB's customer service center by calling 18202 (call charges based on the current price list of the respective telecommunications provider) giving the order number,
•    and wishes to change a delivery detail, i.e. the address and the time, this can only be made through the AB customer service center by calling 18202 (call charge based on the current price list of the respective telecommunications provider) giving the order number,
•    he will not receive AB loyalty program points with the purchases made as a "guest",
•    he will not be able to declare his loyalty card or redeem points,
•    he will not see his order history and for any issue that arises he should know the order number,
•    his personal information will be kept in AB's files for a period of 90 days from the day after the submission of the order exclusively for the service of the order and the business relationship between us,
•    AB may contact the information provided by the user exclusively for issues related to the order he has submitted.
•    he will not be able to use the paper discount vouchers worth €6 that he may have in his possession.

By completing and submitting the order you must accept these terms in their entirety.

 

FINAL TERMS

Each order is eligible for points based on AB's loyalty programme. These points appear along with the total estimated cost and may be credited to the AB PLUS loyalty card held by each user and provided the card has been linked to the web account when the web account was first created.
All contents of the e-shop, including images, graphics, photographs, drawings, text, and AB services and products are the intellectual property of AB and are protected by applicable provisions in Greek and European laws. Any copying, distribution, transfer or alteration of the contents hereof for the purpose of directly or indirectly misleading the consumer public and/or harming AB's reputation is prohibited. 
Names, images, logos and brand names representing third-party products and services are the exclusive trademarks of the third parties and are protected by laws in effect. Their appearance in the e-shop in no way implies transfer or assignment of permission or rights to use them.
Users should not under any circumstances provide personal information, even if receiving e-mail that appears to be from AB and which requests personal information and the password they have selected and which users have never provided to AB. Such incidents are most likely third-party fraudulent acts aimed at acquiring your personal data. If you receive such a message, you should contact AB immediately.
AB maintains a record of the data of e-shop users / customers. These data have been voluntarily declared by the persons themselves and are intended to help support, promote and execute the transactional relationship. These data may also be received by third natural or legal persons solely for the purpose of advertising AB’s products and/or services or for the execution of market surveys on behalf of AB, acting in the name and on behalf of AB. Users of the AB e-shop reserve the right to be informed or to object to the further processing of their data under the terms of Articles 11-13 of Law 2472/1997, as in force. ATTENTION AB bears no responsibility towards users in the event that they declare their personal data to a third party through a hyperlink from the e-shop to the third party’s website.
It is possible, through the e-shop, for users to place orders from their personal account to a third party (natural person). In such cases, AB does not acquire data related to the third party and the third party bears no obligation to AB. The message is forwarded to the third party (natural person) on behalf of the user who has chosen to make use of this service through AB's e-shop. Every user using the service through their personal account is exclusively responsible for sending the message and for its content. Any use of the service to send junk mail, spam, or messages that may directly or indirectly harm AB's reputation or are contrary to accepted principles of morality is expressly forbidden. AB is entitled to exercise its legal rights in the event of violation of the above.
These terms are governed by Greek and European Union laws in force. The courts of Athens, Greece, have jurisdiction over any issue arising from these terms.
